1. Services
Bebanoch Roadside provides towing, roadside assistance, and vehicle recovery services within Indiana and other operating areas. Services include towing, winching, jump-starts, tire service, fuel delivery, and lockout assistance.
2. Customer Authorization
By requesting service, you authorize Bebanoch Roadside to tow, transport, and store your vehicle. This constitutes express consent and authorization consistent with applicable Indiana towing and recovery regulations.
3. Vehicle Condition & Disclosure
- You must disclose any known issues affecting towing (e.g., locked wheels, brake failure).
- You are responsible for removing personal belongings.
- You confirm you have legal authority over the vehicle.
4. Pre-Tow Inspection
We may document vehicle condition through photos or reports prior to towing. This serves as official condition evidence.
5. Towing Risks
You acknowledge inherent risks in towing, including damage due to pre-existing conditions, environmental hazards, or mechanical failure.
Important: Bebanoch Roadside is not liable for damages caused by undisclosed defects, prior damage, or conditions beyond reasonable control.
6. Storage, Lien & Abandoned Vehicles (Indiana Compliance)
- Vehicles may be stored at our facility or authorized storage locations.
- Daily storage fees will apply.
- We retain a statutory lien on vehicles for towing, recovery, and storage charges under applicable Indiana law.
- If a vehicle is not claimed, we may initiate abandoned vehicle procedures, including notice to the Bureau of Motor Vehicles (BMV) and potential sale or disposal in accordance with Indiana law.
7. Payments & Chargebacks
- All charges must be paid in full before vehicle release.
- You authorize all service-related charges.
- Fraudulent disputes or chargebacks may result in collections or legal action.
8. Insurance & Claims
Damage claims must be reported within 24 hours. Claims are evaluated based on inspection records and operational data. Compensation is not guaranteed.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED UNDER INDIANA LAW, LIABILITY IS LIMITED TO THE AMOUNT PAID FOR SERVICES. WE ARE NOT LIABLE FOR INDIRECT OR CONSEQUENTIAL DAMAGES.
10. Disclaimer
SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES EXCEPT AS REQUIRED BY LAW.
11. Indemnification
You agree to indemnify Bebanoch Roadside against claims arising from misuse or inaccurate information provided.
12. Dispute Resolution
Disputes shall be resolved through binding arbitration in Indiana under the rules of the American Arbitration Association.
13. Class Action Waiver
You waive participation in class or collective actions.
14. Governing Law
These Terms are governed by the laws of the State of Indiana.
15. Force Majeure
We are not liable for delays caused by weather, road conditions, or events beyond our control.
